Terms and conditions of use

These Terms and Conditions of Use (the Terms and Conditions) regulate access to the content and services offered through the website www.protec.com.mx (hereinafter, the Portal).

The navigation and use of the tools and services offered through the Portal imply the acceptance of these Terms and Conditions in everything that is applicable to your rights as a visitor and, where appropriate, as a user of the Portal services.

These Terms and Conditions also establish the information referred to in article 76-BIS of the Federal Consumer Protection Law (LFPC) in force in the territory of the United Mexican States (“Mexico”).

About PROTEC

PROTEC AGENTE DE SEGUROS Y DE FIANZAS, S.A.P.I. DE C.V. (hereinafter “PROTEC”) is one of the most largest specialized independent brokers (insurance broker) in the development and implementation of commercial insurance programs, employee benefits programs and surety bonds as well as risk management.

The Portal operates as a price reference for other services and products, grouped under categories identified in the Portal itself. The person responsible for the Portal complies with all the regulations applicable to its activity as a service provider.

Object and scope of application

These Terms and Conditions regulate the use and navigation through the Portal, as well as the use of the services offered through it.

For the purposes of these Terms and Conditions, and subject to the provisions of the LFPC, the terms "user or consumer", indistinctly, mean any natural or legal person who accesses the Portal to learn about its content, request information, access the services offered and send information through any of the forms provided for such purposes, in its different sections; for such purposes, the final recipient of the information and services provided through the Portal are natural persons of legal age, professionals or companies residing or domiciled in Mexico.

Supplier identification and location

The services related to the Portal are provided by PROTEC, AGENTE DE SEGUROS Y DE FIANZAS, S.A.P.I. DE C.V. (hereinafter "PROTEC").

Service's description

PROTEC through the Portal is presented as an independent comparator that provides the best available prices of the product or service requested by the user, according to the user’s profile of consumption and complementary services that result from the data provided , but at all times acting impartially, as well as transparently and objectively with the information it provides.

The services provided by PROTEC are aimed at users looking for the best price for a specific product or service. With regard to users who are natural persons, it is important to indicate that the use of the services is only allowed for those who are over 18 years of age.

Use of services: Insurance

When the user agrees to obtain an insurance comparison, he must bear in mind that PROTEC acts at all times as an intermediary for various insurance entities. The function of PROTEC is limited to offering the comparison of budgets in the insurance modality that the user requests and that results from the data provided by the user through the PROTEC questionnaire that he must complete, answering the questions that appear in it and that they are absolutely essential and necessary to be able to carry out the requested comparison. PROTEC at no time participates in the contracting of the service or product that the user finally chooses, as well as in the management of the policy.

All prices provided by PROTEC will include VAT (Value Added Tax) and any other applicable expenses or taxes, although if there is any extra expense, it will be clearly and precisely referred to.

Once the user has obtained the price comparison of the product or service, PROTEC makes the following services available to the user:

The prices of the product or service whose comparison has been requested by the user, when this panel appears on the Portal, the user is offered the possibility of being able to modify the data that he has provided in the PROTEC questionnaire, by clicking on the "Start ” or “Change quote”. Once the user has modified the data, PROTEC will carry out the comparison of prices or rates of the chosen product or service.
2. In the event that the user wishes to contract the product or service, PROTEC makes available to the user within the Portal:
the necessary information that the insurance institution provides to PROTEC for contracting directly in the Portal of the chosen product.
b. the direct link that will redirect the user to the page of the chosen company, where they can contract directly with the provider of the chosen service or product as long as the Insurance Institution so facilitates it, but never with PROTEC.

Personal data protection

The personal data provided by the users will be used to carry out the price comparison of the product or service chosen by the user and, where appropriate, internal analyzes to improve the Portal service.

Complete information on the use of your personal data is described in the Privacy Notice that is available for consultation through the Portal itself (www.protec.com.mx).

Responsibility of the parties

The user will be responsible for the data provided in the corresponding questionnaire, on which the price comparison will be based; for this reason it is required that they be truthful and precise. In the event that the user makes use of the service provided by PROTEC with data that is not his, he will be responsible for the consequences of not having the corresponding authorization from the owner of such data.

PROTEC will not be responsible in any case and under any circumstance when the user has not provided truthful or exact data and that, as a consequence, the provider of the service or product decides not to contract with the user.

Through the Portal, the user does not contract any service or purchase any product owned by PROTEC , so PROTEC will not be responsible for the terms and conditions of the contracts that the user signs with the corresponding supplier, after the comparison made. PROTEC is also not responsible for:

1. the possible contingencies or damages that may arise in the relationship between the user and the provider during the term of the contract, and even when it has already ended.
2. the unavailability of the products or services chosen for contracting with the supplier, due to circumstances beyond PROTEC's control or due to force majeure.

PROTEC will not be responsible for the functionality of the links to other contents, nor for the information of third parties accessible through said links, which are published on the Portal, when said information is illegal or damages property or rights of a third party susceptible of compensation. However, as soon as it becomes aware of it, PROTEC will proceed with due diligence to remove or disable the link to the corresponding content or information.

The websites that the user can access from the Portal are owned and managed by entities outside PROTEC, so PROTEC will not be responsible for their operation, content, or the products or services they offer. However, as soon as it becomes aware that its content is illicit or damages property or rights of a third party liable for compensation, PROTEC will proceed with due diligence to remove or disable the direct link from the Portal to the corresponding website.

PROTEC tries to guarantee the best updated price of the product or service whose comparison the user requests. However, PROTEC will not be responsible for possible errors or omissions in the price, when it does not coincide with the one offered on the website of the supplier of the chosen product or service, if the cause of the error is not due to circumstances attributable to PROTEC.

Users undertake to use the Portal in a lawful and diligent manner, with respect to the services offered therein and, especially, not to carry out any use of the Portal that may be contrary to the purposes established in these Terms and Conditions or to the law.

PROTEC reserves the right not to provide its services to any user who carries out a fraudulent use of the Portal or who breaches or contravenes any of the conditions contained in these Terms and Conditions, and in such case, said user's access to the Portal may be denied.

PROTEC will not be responsible for damages, of any nature, that users suffer as a result of non-compliance with the provisions of these Terms and Conditions, in the Integral Privacy Notice of USERS AND CONTACT, or of any other obligations established by current and applicable regulations.

PROTEC does not guarantee that the content of the Portal or the information provided therein will respond to specific user requirements.

No content or information obtained by a user through the Portal may constitute a guarantee granted by PROTEC, if it has not been expressly assumed in these Terms and Conditions.

Intellectual property

All industrial or intellectual property rights over the www.protec.com.mx domain, the “PROTEC” brands and logos, as well as the contents of the Portal (texts, images, logos, videos, graphics and any others), under any format, are legally reserved for protec.com.mx.

Access to the Portal, or the use of the services by users, cannot be considered in any way the granting of any right, authorization or license of any kind with respect to the contents of the Portal. The reproduction, transformation, distribution, public communication, making available, extraction, reuse, forwarding or use of any nature, by any means or procedure, of any of such content is expressly prohibited, unless prior authorization is obtained expressly and in writing from the owner of all corresponding rights.

Commercial use

The Portal is not for commercial use. PROTEC reserves the right to take legal action against anyone who attempts to use the Portal's services in an unauthorized manner.

The copyright on the material contained in the Portal belongs to protec.com.mx. Any individual, acting in the private sphere, may print a copy of any part of this material for their own personal use, subject to the following conditions:

1. The material may not be used for commercial purposes. Any copy must retain any copyright (or similar) notices contained in the original material.

2. The technology and processes used or described in the Portal may be subject to other intellectual property rights, reserved to protec.com.mx or any other company owned by PROTEC, AGENTE DE SEGUROS Y DE FIANZAS, S.A.P.I. DE C.V.
3. The images displayed on the Portal are protected in accordance with applicable national and international regulations, and may not be reproduced or displayed in any way, without the written consent of their respective owners.
4. No logo or trademark that appears on the Portal may be printed or copied, except as part of the text of which it is a part.

Additional provisions on the use of the Portal

PROTEC warns its users that the descriptions of the products or services offered on the Portal are made exclusively for informative purposes, and in accordance with the information and documentation provided to PROTEC by the providers of those products or services.
The photographs, videos and graphic or iconographic representations of any kind, related to the products or services offered on the Portal, including trade names, trademarks, distinctive signs of any kind or denominations contained in the Portal, only have illustrative or indicative purposes, in order to offer the greatest possible information to the user, but without being binding on PROTEC.

Despite the security measures that are adopted, PROTEC does not guarantee the absence of viruses or other elements that could damage or alter the user's computer system, and PROTEC does not assume any responsibility derived from it.

Validity, changes and updates

These Terms and Conditions will be valid from June 4, 2020.

Acceptance of these Terms and Conditions implies acceptance of the latest version published by PROTEC.

PROTEC reserves the right to modify at any time and without prior notice the presentation, configuration and contents of the Portal, as well as these Terms and Conditions.

PROTEC recommends users to carefully read these Terms and Conditions, as well as the "Privacy Notice", before starting to use our services and sending your information.

When changes are made, PROTEC may communicate them by means of a message or banner visible for a reasonable period of time, on the Portal itself.

If any part of these Terms and Conditions or the "Privacy Notice" is declared invalid by a competent judicial authority, the rest of the content will remain in force and will be interpreted taking into account its purpose.

The non-exercise by PROTEC of any right derived from these Terms and Conditions and the "Privacy Notice" will never be interpreted as a waiver of said right, which can only be done expressly and in writing.

Applicable Jurisdiction and Law

The Portal and the services offered therein are directed exclusively for the territory of Mexico and for residents within it.

The Portal and the services offered therein will be governed by the legislation in force in the United Mexican States.

For any controversy related to the interpretation, execution and validity of these Terms and Conditions, the legal jurisdiction will be with the Courts of Mexico City.
